Terms and Conditions

These terms are the agreement between you and Birdsms Global Networks Ltd. about using Birdsms. Please read them — particularly the parts about your balance and about what you must not do with a number, because those are the two that end accounts.

This document is not finished. The operator has not yet set a registered address or a governing jurisdiction, and it has not been reviewed by a lawyer. Please ask before relying on it.

What this service is

Birdsms rents virtual phone numbers and routes the SMS that arrive on them. There are two ways to use it and you may use both.

Earning. You take a number from an earning route and we pay you for each qualifying message that arrives on it, at the rate shown on the route when you take it.

Paid numbers. You take a number from a paid route and we charge your balance for each message that arrives on it, at the price shown on the route when you take it.

A number is rented to you for a stated period. When that period ends the number returns to us and may be given to somebody else.

Who may use it

You must be at least 18 years old and legally able to enter a contract where you live.

One person, one account. An account you share, sell, or operate on behalf of somebody else may be closed and its balance held while we work out whose it is.

We may refuse or close an account. Where we do, the reason is recorded and you can ask for it.

What you must not do

Use a number to send spam, to harass anybody, or for anything unlawful where you are or where the number is.

Use a number to create, verify or access an account that is not yours, or to take over somebody else’s account anywhere.

Automate against this site beyond what the published limits allow, or work around a rate limit, a cooldown, or a captcha.

Register more than one account to get around a limit, a promotion, or a suspension.

Resell access, republish the traffic feed, or pass numbers on to somebody who has not agreed to these terms.

Interfere with the service, the numbers other people hold, or the delivery of their messages.

Messages, and what we can and cannot promise

A message arrives or it does not. We do not control who sends to a number, whether a sender reaches it, or how long it takes — those belong to the mobile networks and to the service you are using the number with.

We do not guarantee that any particular message will arrive, that a number will work with any particular service, or that a route will stay available.

Messages that arrive on a number rented to you are shown to you. Parts of them may be hidden from other people, and parts of other people’s messages are hidden from you. What is hidden is set by us and can change.

We keep messages for a limited time. The screens say how long.

Your balance, what we pay, and what we charge

Your balance is a record of what we owe you. It is not a bank account, it earns no interest, and it is not protected by any deposit-guarantee scheme.

Earnings are credited when a qualifying message is recorded. A message that arrives from a sender we do not pay for, or past a route’s message limit, is shown to you and earns nothing — the screen says which.

Paid-route charges are taken from your balance when the message arrives. If your balance will not cover a charge, the message is still delivered to you and the shortfall is recorded.

Rates and prices can change. A change applies to numbers taken after it, never to a number you are already holding.

Deposits are credited when the payment is confirmed on the network or by the payment provider. A deposit that arrives short of what was declared is credited at what actually arrived.

Withdrawals are paid to the account you give us. You are responsible for that account detail being correct. A payment sent to an address or number you typed wrongly cannot be recovered by us.

We may hold a withdrawal while we check it. Where we refuse one, the money goes back to your balance and the reason is recorded — except where we believe the balance was obtained fraudulently, in which case it is held pending investigation.

Fees are shown before you confirm a withdrawal or a purchase.

Suspension and closure

We may suspend an account immediately where we believe it is being used for anything in "What you must not do", where an account is being used to defraud us or somebody else, or where we are required to.

A suspension is recorded with a reason and the name of the person who applied it. You can ask for both.

You can close your account at any time by asking support. A balance owed to you is paid out first, less anything properly owed to us.

We may close an account that has been dormant for a long time. We will try to reach you at the address on the account first.

What we are not liable for

We provide the service as it is. We do not promise it will be uninterrupted or error-free.

We are not liable for what you do with a number, for anything a third-party service does because you used one of our numbers with it, or for a message that does not arrive.

Where we are liable, our liability to you is limited to the amount we have paid you, or you have paid us, in the three months before the event — whichever is larger. Nothing here limits liability that cannot be limited by law.

Changes to these terms

We can change these terms. The current version and its date are always at the top of this page.

Where a change materially affects you, we will tell you before it takes effect and you can close your account and withdraw your balance if you do not accept it.

Continuing to use the service after a change takes effect means you accept it.

Law and disputes

These terms are governed by the law of — governing jurisdiction not set —, and disputes are heard there.

Before that, please write to us. Most things are a misunderstanding and are fixed in a message.
